Landscaping rules

The boundaries and general quadrature of the local area are determined by the cadastral or technical passport real estate. According to Article 16 of the Housing Code, this territory belongs to all residents of the house on a shared basis. The maintenance and care of it is carried out by the management company or, as well as by the residents themselves and the contractor companies with whom the service agreement was concluded. They, for example, carry out repairs of the local area of ​​​​the apartment building.

Residents are obliged to keep order in an apartment building and the plot of land belonging to it, not to litter, not to damage buildings, and so on. After all, after residents become owners of real estate, they undertake to maintain it in order on the basis of the relevant government decree.

The rules for maintaining the local area and its operation for owners of apartments in a multi-storey building include:

  • sanitary maintenance of areas where trash cans and garbage containers are installed;
  • , garbage removal;
  • preservation of flower beds and other landscaping areas.

In most cases, residents enter into agreements with management companies, which are responsible for the care and maintenance of the courtyard area of ​​an apartment building. But in old houses, the municipality is often responsible for this, unless the land around them is privatized, since it still belongs to the state. And in this case, it will also be responsible for the improvement of the local area of ​​the apartment building.

The list of works for landscaping and maintaining the yard also depends on the time of year. In winter:

  • landscaping of the local area;
  • creation of a children's playground in the yard;
  • painting benches, fences, parts of structures installed around the site;
  • installation of fences in the local area;
  • repair work, as well as ensuring the safety of homeowners (sanding paths in icy conditions, destroying icicles, installing manhole covers, etc.).

Let's take a closer look at the elements of landscaping courtyard areas:

  • landscaping: can be roof, vertical, house;
  • arrangement adjacent areas ramps, steps, stairs;
  • surface: lawn, hard or soft, asphalt;
  • fencing areas: fence, hedge;

Asphalting

For this purpose, the management company creates a special fund into which residents contribute money for the work of laying asphalt.

That is why the procedure is such that the organization of the fund is carried out after a meeting with voting and calculation of the approximate cost of the work. After all, not everyone is ready or able to pay the required amount. As always, the issue is decided by a majority vote in favor. More than half of the owners must be present at the meeting.

  • the asphalt coating layer should not be less than the established standard of 15 cm;
  • It is recommended to use a fine-grained composition;
  • 1 meter is the minimum width of asphalt laid around the house;
  • mandatory laying of pavement on paths leading to the entrance and parking areas.

Fencing rules

Fencing the local area of ​​an apartment building is permitted by law, but has a number of established norms and restrictions:

  • install the fence in such a way that it does not block the passage or passage to the house, otherwise this will be regarded as a deliberate attempt to prevent repair specialists or personnel servicing technical equipment or power lines from entering. In this case, the fence will be demolished;
  • fences of the local area should not be an obstacle for residents of neighboring houses or courtyards when moving through the fenced area, otherwise they will be demolished after complaints received;
  • the yard cannot be completely blocked;
  • Partial or complete fencing of the playground and parking lot is permitted.

  • ambulances;

What to consider when landscaping

  • maintain the natural green surroundings of the house;
  • not to destroy without permission or damage trees, shrubs and other plantings in the local area, which will be regarded as an offense and fall under administrative liability;
  • It is recommended to regularly mow lawns and shrubs;
  • do not increase the area of ​​lawns by reducing pedestrian and travel paths;
  • observe timely watering;
  • remove dead wood that may threaten human life;
  • V winter period do not store collected snow containing reagents around trees;
  • do not trample lawns and flower beds;
  • do not use trees as supports for swings or as advertising poles;
  • do not adapt green spaces for commercial needs;
  • It is prohibited to arrange parking areas in the green zone;
  • It is also prohibited to set up a warehouse for building materials.

If yards are landscaped with ponds, they should be constantly cleaned and care should be taken to ensure that the water does not bloom. To change the landscape of a green area, it is necessary, after a meeting at which the improvement scheme is approved, to be agreed upon with the municipal authority.

Arrangement of a children's playground

In situations where neither the house nor the adjacent territory are privatized and remain state property, the construction and subsequent maintenance of playgrounds is carried out by the municipality. If the high-rise building is privately owned, then the management company is obliged to undertake obligations for the construction, arrangement and maintenance of the playground.

The construction and maintenance of playgrounds for children must comply with GOST standards:

  • placed away from the roadway and pedestrian paths;
  • fence with green spaces that could provide shade in the summer;
  • sanitary standards must be observed (regular replacement of sand 1-2 times a year, and so on);
  • the site should not be close to parking, warehouses or garbage cans, minimum distance from them – 20 m;
  • monitor the cleanliness of the facilities located on the site.

Management company employees are required to monitor the condition of the site:

  • inspect regularly;
  • make written and photographic reports;
  • remove trash;
  • make repairs.

The landscaping scheme in accordance with GOST provides for structures for playgrounds intended for children of different ages, as well as their separation. But in practice, most often they are located in the same area without any distinctions. As a rule, this happens due to insufficient building space. Therefore, in order not to violate the rules for landscaping the local area of ​​an apartment building, it is necessary to install at least one structure for each age category.

How to landscape a yard

In order to improve the yard, it is necessary to hold a meeting of the owners of the apartments in the building. It will discuss specifically what measures to improve the local area are planned to be carried out, the design of the yard is proposed, and a vote will be held. Who pays

Residents pay for landscaping work in courtyard areas of apartment buildings, whether they own residential property or just rent it. Of course, you can improve the yard with your own hands if there are activists who want to do small construction and other necessary work. In practice, this does not happen very often. Also, such activities can be carried out at the expense of public funds, if this is an ongoing federal improvement program.

Repairs to the local area of ​​an apartment building are also carried out at the expense of the residents. Repairs are considered current:

  • damaged sections of the road, that is, partial asphalting or another method;
  • fence and other enclosing structures;
  • children's facilities;
  • sports designs.

The overhaul includes:

  • paving;
  • landscaping;
  • installation of fences and buildings;
  • equipping utility areas, children's and sports areas.

According to the adopted improvement program, the maintenance of cities and urban areas most frequently used by people has reached a new, better level. Landscaping of courtyard areas involves the implementation of a set of works aimed at creating a comfortable, aesthetically designed area. During the work, ideas for landscape design are being implemented and areas for leisure activities are being built that comply with the sanitary standards of the Russian Federation.

Arrangement of courtyards of apartment buildings involves the following activities:

  • regular checks of the condition of amenities located on the territory (for example, lighting fixtures, curbs, sidewalks, fences, etc.), in order to timely identify damage and breakdowns leading to violation of sanitary and hygienic requirements. Inspection is carried out daily;
  • in case of detection of malfunctions of objects, measures must be taken to eliminate them;
  • carrying out measures established by standards aimed at caring for landscaping elements (pruning bushes, mowing lawns, watering, etc.);
  • carrying out work to clean landscaping elements created to drain groundwater and storm water (drains, ditches, pipes) from debris in order to ensure their normal functioning. This is done as needed, but once in the spring is mandatory;
  • carrying out “restoration”: painting, whitewashing, cleaning, etc. - once a year (more often if necessary) in order to maintain the elements of courtyard areas in an appropriate aesthetic form;
  • emptying bins of garbage (regularity depends on the speed of filling). In the warm season, they must be washed and disinfected monthly, and painted or whitened once a year (moreover, metal urns must be painted at least 2 times during the year: in autumn and spring);
  • cleaning the territory (clearing debris and snow, sweeping, etc.) in order to keep courtyard areas clean;
  • collection and removal of household waste according to the established schedule.

Comprehensive improvement involves carrying out current and major repairs of its facilities, namely:

  • as necessary, the road surface is repaired or completely changed (this also applies to sidewalks and driveways);
  • as necessary, small architectural forms and their elements are installed or restored;
  • bins are installed once and container areas are equipped, which, in accordance with sanitary and hygienic requirements, are periodically restored or replaced;
  • as necessary, work related to the care of landscaping objects is performed;
  • as necessary, broken fences and fences, utility and sports grounds, gazebos or other specially equipped recreation areas for residents are repaired and restored;
  • as necessary (however, at least once a year), outdoor lighting objects are repaired and their supports are painted;
  • as necessary, landscaping objects are trimmed, cut down, crowned or “treated” (dry tree branches are cut down, lawns are renewed or mowed, hedges are shaped).

The improvement of courtyard and public areas is carried out in accordance with certain regulatory documents, which, among other things, determine the nature repair work(current or capital).

The creation of new elements involves:

  • landscape work: covering pedestrian paths, traffic areas and parking lots with paving slabs or asphalt, construction of small architectural objects (sculptural compositions, flower beds, lawns, fountains, etc.), installation of fences, fences, etc.;
  • landscaping work: planting shrubs and trees, forming hedges and other work approved in project documentation;
  • work on lighting equipment: installation of outdoor lighting objects and artistic lighting for lighting design of the yard and area.

What work is being done to improve the yard area?

The Ministry of Transport of the Russian Federation has developed and approved a document regulating work related to major and current repairs of facilities aimed at improving courtyards and public areas, and their maintenance. These requirements are specified in the Classification of Works by major renovation and road maintenance public importance and the maintenance of the structures installed on them.

The basis for establishing the list and timing of road work is: a list of defects, diagnostics, engineering reports, design and other documents that provide a realistic assessment of the condition of a particular object.

  • Removal of chipped asphalt. The work is carried out by a company that repairs road surfaces. The timing depends on the importance of the highway (road): on the main ones - they are removed immediately (as the chip appears), on secondary ones - within 24 hours.
  • Cleaning up waste from logging landscaping objects. The work is carried out by logging companies.

The timing of removal of waste from cutting down landscaping depends on the importance of the highways and streets along which the work is carried out: from main streets - until the end of the working day, from secondary streets and courtyards of apartment complexes - within 24 hours.

  • Kick it, those that appeared as a result of cutting down landscaping objects and are located along the main roads must be uprooted within 24 hours; if the stumps are located on secondary streets or in the courtyards of apartment buildings, then three days are given for their removal.
  • Fallen trees cleaned by the owner (owner) of the territory. If a tree has fallen on the roadway, sidewalk, next to live wires, in front of the façade of a house or industrial building, it must be removed immediately. 8 hours are given to free other objects from the moment the fallen tree is discovered.
  • Cleaning bins carried out at least once a day, it is advisable that this be done as they are filled. Damaged ballot boxes must be repaired or replaced within 24 hours from the moment the damage is discovered.
  • Container sites must comply with approved sanitary and hygienic requirements, according to which garbage must be removed every day in the warm season, and 2-3 times a week in the cold season. It is necessary to restore order on the site every day. The improvement of courtyard areas implies the maintenance of container sites, so this is the responsibility of the organization with which an agreement has been concluded for the removal of solid and bulky waste. If there is no such agreement, then this element falls on the shoulders of those who own the land plot allocated for garbage containers.

Cleaning of the territory related to apartment buildings, courtyards, places with large crowds of people (for example, station squares, markets, squares, etc.) is carried out throughout the working day.

The improvement of courtyard areas is closely related to landscaping, because it pursues the same goal: creating a harmonious space on a specific site.

Modern courtyards of apartment buildings are a space organized in a special way and satisfying the basic needs of residents; each part of the courtyard is unique and has a specific functional purpose. Landscaping of courtyards covers all elements of a modern courtyard: paths, platforms, driveways, house strips and landscaping, creating a single compositional solution, which is in harmony with the concept of the entire area.

  • House strip- a rather unique element of the yard, subject to landscaping and carrying different functional loads (protective, environmental and aesthetic). The area adjacent to the house can be landscaped in different ways, it all depends on the desires and capabilities of the owners: from planting flower beds and lawns to installing sun loungers and benches. The width of the strip is not standard and ranges from 3-15 m; naturally, this is reflected in its “functionality”: it protects from dust and noise, purifies the air, or is simply pleasing to the eye.

Often the house strip is used to highlight the entrance to the house: climbing plants, unusual shrubs or trees are planted, various lighting is installed, etc.

  • Garden paths and various sites, according to current regulations, must account for at least 15% of the total undeveloped area of ​​the yard. Today, much attention is paid to the improvement of urban courtyard areas, because the courtyard should be convenient and comfortable. The width of courtyard paths is affected by the intensity of pedestrian traffic along it. The permissible width of pedestrian alleys ranges from 2.5 to 3 m, paths - from 1.5 to 2.5 m, and paths - from 0.5 to 0.75 m (usually the same width is set from beginning to end, but it is possible and extraordinary design). If benches are installed along the path, then a kind of “pocket” is created (a recess of up to 1.5 m). Paths can be covered with asphalt, concrete (both monolithic and tiles), side stones, brick or gravel chips, etc.
  • Playgrounds. For children of different ages (nurseries, preschoolers and primary schoolchildren), separate playgrounds fenced off from each other are installed. Shrubs or other landscaping objects are usually used as fencing. If it is not possible to allocate a lot of space for the site, then the width of the plantings is reduced and can be 0.5-1 m. This often leads to the fact that they are gradually “compared” to the ground. In this case, it is advisable to carry out landscaping of courtyard areas and place children's and sports grounds, outbuildings, be guided by approved standards, according to which they must have such qualities as pedestrian accessibility and minimal fencing.

Landscaping children's playgrounds has several purposes: protection from the wind, providing shade in the hot season and, most importantly, isolation from the roadway. In addition, the sites must have optimal lighting and be well ventilated.

The choice of plants must be approached quite seriously. Thorny bushes and plants with poisonous or inedible fruits should not be planted. It is better if these are trees and shrubs that have a beneficial effect on the environment and are good for health.

  • Sports grounds equipped, calculating the footage according to the number of residents (1 m 2 / 1 person). They can be placed in the space between courtyards if the residential area is too densely built up. In this case, it is necessary to maintain a distance from the windows of the house (at least 15 m). When landscaping sports grounds, several conditions must be met: firstly, the grounds must be well ventilated; secondly, planted hedges should provide protection from noise and sun. If a mesh fence is installed around the site, then it is advisable to let climbing plants along them. Trees with a dense crown must be planted along the entire perimeter of the sports ground. Before planting, it is worth taking into account that the crown of the trees should be dark, and the trees themselves should be wind- and frost-resistant (so that broken branches do not fall onto the site). These plantings should not bloom brightly and litter the area with petals and seeds.
  • Business sites are arranged taking them into account functional purpose: cleaning and airing clothes, drying clothes, beating carpets, installing garbage containers, etc.

When landscaping courtyard areas, it is important to take into account that utility areas must be isolated from recreational areas and other areas either by green spaces or walls built of brick or concrete blocks (in this case it is necessary to use vertical landscaping by planting climbing plants).

  • Areas for drying clothes, like areas for airing clothes, they must be protected from dust, but at the same time they must receive a lot of sun. As a rule, they have a lawn and tiled surface, and the perimeter of the site is landscaped.

An initiative group is assembled from interested parties. It is important to consider whose property the yard is. It may belong to:

  • owners of one apartment building (included in common property);
  • owners of several apartment buildings (on land plots of two or more apartment buildings);
  • municipality;
  • owners of several apartment buildings and the municipality (a municipal plot is located between the land plots of apartment buildings).

To find out, you need to find out land boundaries, if they are defined. Information about the boundaries of a land plot can be found in the cadastral passport of the building or on the Rosreestr website.

No matter who owns the yard, it is possible to arrange it according to the program.

If the yard is common to several houses, then the initiative group should include representatives of each house. The initiative group solves the following tasks:

  • create a yard plan,
  • determine the list of works and the scope of participation of residents,
  • conduct OSS,
  • control the implementation of ideas at all stages.

Works to help residents in every municipality public commission. It brings together experts in landscaping, construction, and local history. Specialists will help you draw the yard and take into account:

  • wishes of the owners,
  • municipal program
  • natural and other features of the territory.

Step 3. Conduct OSS

With the finished drawing, the initiative group goes to the general meeting of owners. If the initiative group includes representatives of several MKDs, the OSS is held in each house with the same agenda.

  • elect the chairman and secretary of the OSS, the counting commission;
  • contact the compulsory health insurance with a proposal to include the yard area in municipal program for creating a comfortable urban environment for 2017 (in this paragraph you should indicate the planned list of works, which corresponds to the established minimum and additional lists);
  • determine the form and share of participation of the owners (the amount of financial participation is indicated as a percentage of the cost, labor participation - in the number of people involved in the work);
  • determine the procedure and source of financing for the work;
  • select the person responsible for the approval of the design project, control and acceptance of work;
  • include the installed objects into the general property of the apartment building for their subsequent maintenance.

Residents will have 1-2 months from the date of publication of the municipal program to prepare and hold a general meeting. And you need to prepare well for such a meeting. After all, if in at least one of several houses OSS solution will not be accepted, the yard will not be included in the program.

The Ministry of Construction of the Russian Federation recommends choosing an in-person form and holding the in-person part of the meeting in all courtyards at the same time. This way, residents will be able to discuss issues together and come to an agreement. All issues on the agenda must be resolved at the meeting.

Step 4. Submit an application

To include a yard in the program, local authorities are sent OSS protocol(one or several depending on the number of apartment buildings to which the yard area belongs) with the decisions made. A landscaping plan can be attached to the protocol.

A public commission will consider the application. It includes representatives of the compulsory medical insurance, political parties, public organizations and so on. The review procedure must be published on the municipality’s website before April 1, 2017.

Municipal program project submitted for public discussion. There the fate of each application will be decided. Residents can take part in the discussion. How to do this is determined by the municipality.

Step 5. Agree on the design project

If the yard is included in the territory development plan, based on the plan (drawing) a design project. It may look different, depending on the amount of work planned. If necessary, it may contain design and estimate documentation or only images of the yard with a description of the proposed works and activities.

The design project must not violate the rights of third parties or interfere with the passage of engineering communications. It will be approved by the responsible person selected at the OSS.

By July 1, 2017, municipal authorities must approve the design project for the yard. This will happen if:

  • authorized on behalf of the OSS, agreed on the project;
  • the owners have fully contributed their share of financial participation to a special account and/or submitted a letter of guarantee that specific named residents will participate in the work.

Once the design project is approved, the competitive selection of contractors will begin. They will begin to develop the territory approximately 1.5 months after the announcement of the competition.

Step 6. Controlling the work

An authorized representative of the owners supervises the improvement work. If he sees that contractors are doing work of poor quality or not in accordance with the project, he writes an appeal to the compulsory medical insurance.

When arranging the territory, workers must comply with accessibility requirements for low mobility groups population.

The plan for the yard must be completed by the end of 2017. The work is accepted by a commission, which includes the person in charge selected at the OSS. Experts can be hired to evaluate the work performed. If the activities are carried out efficiently and according to the project, an acceptance certificate is signed.

Step 7. Maintain the yard area

And now in front of your house there is a new, modern site, into the creation of which you have invested your labor and finances. Think about how long it will remain in this form: like in the picture of the design project? After all, any property needs to be monitored, maintained and repaired. Here the owners need services management organization.

To make a decision on the maintenance of the courtyard area, the initiative group collects proposals from the management authority, HOA, service organizations and submits them to the general meeting of owners.

The OSS decides which organization will maintain the yard and how this work will be paid for.

Several organizations can simultaneously maintain a yard common to several apartment buildings.

Remember that when maintaining a yard area, its characteristics must be taken into account.
